Terms of Service

1. Acceptance of Terms

By accessing or using Mello ("Platform"), operated by Megallow Technologies Pvt. Ltd. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Description of Service

Mello is a premium managed rental platform connecting tenants with verified rental properties in Delhi NCR. Our services include:

• Property discovery and booking
• Zero Deposit Rental Bonds (in partnership with licensed surety providers)
• 72-hour move-in service
• RentRewards loyalty program
• Tenant dashboard and rent management
• Maintenance and support services

3. User Eligibility

To use Mello, you must be at least 18 years of age and have the legal capacity to enter into contracts. By using our Platform, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. Booking and Payments

5.1 Booking Token: To reserve a property, you must pay a booking token (typically ₹5,000-₹10,000). This amount is adjustable against your first month's rent upon successful move-in.

5.2 Rent Payments: Rent is due on the 1st of each month. Late payments may incur a fee of 2% per week of delay, up to a maximum of 10%.

5.3 Zero Deposit Bonds: In lieu of traditional security deposits, we offer Rental Bonds at 10-15% of monthly rent through our licensed surety partners. Terms and conditions of the bond are governed by the issuing partner.

6. Lease Agreements

A separate Lease Agreement will be executed between you and the property owner (facilitated by Megallow). The Lease Agreement contains specific terms regarding tenancy duration, rent, maintenance obligations, and house rules. In case of conflict between these Terms and the Lease Agreement, the Lease Agreement shall prevail.

7. RentRewards Program

RentRewards allows you to earn MelloCoins on eligible rent payments. Key terms:

• Earn 1-3% back on on-time rent payments
• MelloCoins have no cash value and cannot be transferred
• Rewards can be redeemed for services, rent discounts, or partner offers
• Rewards expire 12 months from date of earning
• We reserve the right to modify or terminate the program with 30 days notice

8. Property Use and Conduct

As a tenant, you agree to:

• Use the property only for residential purposes
• Comply with all house rules specified for your property
• Not sublease or assign your tenancy without written consent
• Maintain the property in good condition
• Report any damages or issues within 48 hours
• Respect other residents and community guidelines

9. Cancellation and Termination

9.2 Lease Termination: Early termination of your lease is subject to the terms in your Lease Agreement, which typically requires 30-60 days notice and may include an early exit fee.

9.3 Account Suspension: We may suspend or terminate your account for violation of these Terms, non-payment, or fraudulent activity.

10. Limitation of Liability

To the maximum extent permitted by law, Megallow Technologies Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through arbitration in Gurugram, India, under the Arbitration and Conciliation Act, 1996. The courts of Gurugram shall have exclusive jurisdiction.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform following changes constitutes acceptance of the modified Terms.
